________________________________________________________________

on 28 April 2006.
________________________________________________________________
APPLICANT CONTENDS THAT:
He suffered a combat wound while assigned to Camp Bucca, Iraq.
In support of his application, the applicant submits a personal
letter, and a copy of DD Form 214, Certificate of Release or
Discharge from Active Duty, a letter from his congressman, AF
IMT 1168, Statement of Suspect/Witness/Complaint, copies of his

________________________________________________________________
STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 1 October
2002, in the grade of airman basic for a period of four years.
On 28 April 2006, the applicant was escorting a detainee to the
isolation box. The detainee refused to enter the isolation box;
instead, he turned and tried to escape. As the detainee was
taken to the ground, the applicant lost his footing and rolled
his ankle. At that point, the detainee came down of top his
ankle which caused the ankle to snap.
On 28 November 2006, the applicant was placed on the temporary
disability retired list in the retired grade of senior airman.
He completed 4 years, 1 month and 27 days of service.
On 13 May 2008, AFPC/DPSOY informed the applicant that the only
way to show that someone suffered combat wounds would be if they
were awarded the Purple Heart Medal. Otherwise, there is no
other authorized entry for the DD Form 214 to show combat wounds
or combat action.
________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we do not find his assertion, in and by
itself, sufficiently persuasive to override the information
provided by the Air Force office of primary responsibility. In
this respect, we note that the only way to show that someone
suffered combat wounds on the DD Form 214 would be if they were
awarded the Purple Heart. Therefore, in the absence of evidence
to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.
________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or
injustice; that the application was denied without a personal
appearance; and that the application will only be reconsidered
upon the submission of newly discovered relevant evidence not
considered with this application.
